Delhi Court Discharges Sharjeel Imam, Asif Tanha in 2019 Jamia Violence Case

INDIA: In a recent development, the 2019 Jamia violence case against Sharjeel Imam and Asif Iqbal Tanha was dismissed by Delhi’s Saket Court. Imam was previously granted bail in the case in 2021. The order was passed by Additional Sessions Judge Arul Verma, at the Jamia Nagar police station in 2019. 

As per reports, Imam remains in custody linked to other FIRs registered against him in connection with the 2020 North-East Delhi riots. As per the report, the two conspirators accused in the Special Cell’s case were suspected of a larger conspiracy behind the Northeast Delhi riots.

Back in 2019, the Jamia Milia University campus witnessed a major fight between common people and the police. The people protesting against the Citizenship Amendment Act (CAA) became violent and started to damage public properties, and the masterminds behind the whole rift are said to be Imam and Tamha.

Imam allegedly made speeches at Jamia Milia Islamia University on December 13, 2019 and at the Aligarh Muslim University on December 16, 2019, where he threatened to cut off Assam and other states in the Northeast from the rest of India.

The FIR charges rioting and unlawful assembly in violation of IPC Sections 124A (sedition), 153A (promoting enmity), L53B (imputations prejudicial to national integration), 505 (statements conducive to public mischief), and 13 (punishment for unlawful activities). They influenced innocent minds and provoked them to take the wrong actions.

However, in favour of the culprits, their lawyer said, “He only campaigned in favour of peaceful protest and not violence.”

At the same time, Mohammed Iliyas was charged with illegal gathering and rioting.
